Mayor DiIanni : "Members of Council, the Public Works, Infrastructure and Environment Committee presents its 21 st report and respectfully recommends Item #1" (hear councillors say carried) "#2 . 3" (hear a glass clink) "3, Councillor Jackson."
COMMENT ON - " 3. Mr. Charles Eleveld of the Taro Landfill Community Liaison Committee, October 26, 2004, respecting policies regarding leach ate and the certificate of approval for the waste facility at 52 Imperial Street. (Item 7.1).
That a letter be forwarded to the Ministry of the Environment to enquire about the status of the membership of the Taro Landfill Community Liaison Committee and other outstanding issues with respect to the Committee."
Jackson : "Mr. Mayor, this is involving, Mr. Charles Eleveld, who appeared before Public Works Committee last week on the Taro Landfill Community Liaison Committee. I haven't served on that committee, but I know Councillor Collins has. I know in the past, other councillors have - primarily from the Stoney Creek area."
"I think part of the frustration we heard from the presenter, last week, was that he and the Committee have presented in the past, before. And it seems like we, as Committee and Council, have referred matters, asked the Ministry for responses. Can I just understand who is going to follow this so it doesn't get lost in the shuffle and Mr. Eleveld isn't back here 6 months from now and we're starting the process again, Mr. Mayor, all over again. So, through you to, maybe the City Manager, or somebody, or the new General Manager of Public Works, Scott Stewart."
"I just need to know somebody on staff is going to follow this up and ensure there is feedback one way or another, Mr. Mayor, to Committee and Council. Can I ask, through you, to the appropriate staff, please; Mr. Stewart, please?"
Scott Stewart - General Manager, Public Works : "Through you, Mr. Mayor, we're working with the Clerk's office on the correspondence that will go out to the Ministry. Once that goes out, we'll follow up with the District Office and have a meeting with staff. And then, we'll report back through Public Works Committee."
Jackson : "I appreciate that. Thank you very much, Mr. Mayor."

REQUEST TO AMEND - " 6. All Outside Boards and Agencies

Ferguson : "Mr. Mayor, I'd like to change one word in that sentence - change 'regularly' to 'annually.'"
Mayor DiIanni : " - to 'annually submit'?
Ferguson : "Yup."

Kevin Christenson - City Clerk : (answers Mayor off microphone - "I think it would be appropriate to have a Mover and Seconder - ")

McCarthy : "What do they currently do, Mr. Mayor?"
Mayor DiIanni : "What do they currently do? Mr. Rinaldo."
Joe Rinaldo - General Manager, Finance and Corporate Services : "Through you, Mr. Mayor, the large Boards and Agencies tend to provide us an Annual Statement. That's usually the normal practice for most of them."
Mayor DiIanni : "So, it sounds like they usually do that; we're just making it more precise. All in favour of the amendment?" (hear councillors say carried) "That's carried. All in favour of [Item] 6, then, as amended?" (hear councillors say carried) "Carried."

COMMENT ON - " 8. Mewburn Sheldon Neighbourhoods Master Servicing Plan Municipal Class Environmental Assessment (PW04133) - (Ward 8) (Item 9.4)
(a) That the Acting General Manager, Public Works, be authorized and directed to file the Mewburn Sheldon Neighbourhoods Master Servicing Plan Municipal Class Environmental Assessment with the Municipal Clerk for a thirty (30) day public review period; and,
(b) That upon completion of the Class EA process, the Acting General Manager, Public Works Department, be authorized and directed to proceed with the property surveys, detailed design and implementation of the recommended measures for the sanitary trunk sewers; and
(c) That the grandfathered Municipal Act Project ID 5169880833 (MA - West 5th - 40m North of Rymal) be repealed and a new capital Project ID 5160480483 (Mewburn & Sheldon Neighbourhood Sanitary Trunk) be set up and funded 100% from Development Charges; and
(d) That the available Development Charge funding in the amount of $736,456.78 be transferred from Project ID 5169880833 (MA - West 5th - 40m North of Rymal) to capital Project ID 5160480483 (Mewburn & Sheldon Neighbourhood Sanitary Trunk) and the balance of the funds required to complete the project, $523,543.22 be funded 50/50 from the sanitary residential development charge reserve (110302) and sanitary non-residential development charge reserve (110303); and,
(e) That upon completion of the Class EA process, the Manager, Real Estate and Property Management, be directed to proceed with the acquisition of lands and easements required to construct the recommended measures for the sanitary trunk sewers and that all costs associated with these lands and easement acquisitions be funded from Capital Project No. 5160480483."
Whitehead : "Thank you, Mr. Mayor. It was appropriate that former Councillor Frank D'Amico was in the audience because I want to recognize that work that Frank D'Amico has done to initiate, embark on this process in respect to the Master Servicing Plan. And soon, we'll be seeing ." (couldn't understand the work he used) "sewer and development. And, the good news we'll see residential development in appropriate area in Ward 8."
"And, and I want to give kudos to all the staff that, behind this report and provided the leadership and the consultation to finally see it through fruition. I believe, if everything goes well, we'll probably see a shovel in the ground as early as next summer. And that's a credit to all those who have worked in this particular file. Thank you."

AMENDMENT - (Collins / Ferguson - CARRIED)
Collins : "Mr. Mayor, Item 11 deals with the appointment of Vice-Chair for 2005 and my amendment reads, it's Moved by myself; seconded by Councillor Ferguson: 'that Item 11 of the 21 st Report of the Public Works, Infrastructure and Environment Committee be amended by adding the words: "for 2005" following the word "Committee" in the second line.'"
Mayor DiIanni : "Thank you. On the amen - did you really want a recorded vote?"
Collins : "No."
Mayor DiIanni : "On the amendment, all in favour?" (hear councillors say carried) "On # 11, all in favour?" (hear councillors say carried) "Unanimously, except for Councillor Jackson. Number twel -" (hear a glass clink) " - No, no - " (hear giggles from Council and gallery) "I'm just kidding."

COMMENT ON - " 12. Re-Naming of Parkdale Arena That the Parkdale Arena be renamed the
Pat Quinn Parkdale Arena."
Bratina : "Through you, Mr. Mayor, I'm delighted to see that Pat Quinn's name has been brought forward to be honoured by the City. I've thought about this quite a lot, myself. And, I grew up and played baseball with Pat and I often thought that the appropriate place, if his name should be received in a civic place, would be Mahony Park -" (http://www.hpl.ca/Collections/PARKEX/mahony.htm) "Not to open up the Crerar / Mahony debate."
"Pat learned to skate on the natural ice boarded up ice of the park, and played baseball, there. And, did a little, played a little bit of hockey in the Parkdale Arena. But, he was so big and so good, so young, that he moved on very quickly. He was into Junior 'B' and Junior 'A' hockey."
"And, I don't recall Pat - although, I know he did play a little bit at the Parkdale Arena, that wasn't his main, sort of, centre of activities. But, I wouldn' t be averse to having the arena named after him. But, I'm just concerned about the process of naming things and the way it goes."
"And, could you direct me on this. We had the issue earlier about the highway that sort of came and went and - is this a neat, clean process? Or, are we sure that enough people have been considered - the arena people and so on - that this would be appropriate and everyone would be happy?"
Mayor DiIanni : "Well, setting this aside, I think we need to look at a process, because we have had a number of requests that have been floated, going forward. And, I know that probably the former City [of Hamilton] did have a protocol and a process. I think we really need to revisit that so that we can do things in a way that might be consistent with any name coming forward."
"But having said that, that's for the future. I think we have this before us, now, for us to make some decision on. Any other comments on #11, then - or sorry #12 and the re-naming of Parkdale - Councillor Merulla."
Merulla : "Thank you, Mr. Mayor. Actually, Councillor Collins and I both had the opportunity of meeting with Mr. Quinn. We had one Thursday morning. And, he - contrary to what Councillor Bratina stated - he actually not only played hockey there, but he had a very close relationship with a number of people who used to associate in that area on a regular basis. So he, and brought back a lot of - which brought back a lot of memories which he discussed with both Councillor Collins and myself. So, I know he's thrilled about it. I know his mother, who lives in Ward 4, is thrilled about it. And I think, frankly, his contribution to hockey - particularly on the international front - is second to no one. And, I proudly stand by this initiative. Thank you, Mr. Mayor."
Mayor DiIanni : "Thank you - "
Bratina : "Can I respond? - Ya, the people that Pat's talking about - through you, Mr. Mayor - of course are the Parkdale east-end kids. And, we all skated in that rink and we all circulated, here. So, I'm not arguing with Councillor Merulla, at all, on the item. I understand that there were some people in the arena organization who wondered how the process got through so quickly. And so, once again, knowing Pat as well as I do, and loving and admiring all of his accomplishments. I'm not going to stand in front of naming anything after Pat Quinn. But, I am concerned that the process is thorough. Thank you."
Mayor DiIanni : "I think the point is well-taken. And, moving forward, we really need to attend to it. And probably, though whose committee is it going to be in the new year?" (hear some people speaking off microphone) "Councillor Bruckler, through your Committee," (Community Services) "probably we need to look at - is that the appropriate committee? - Ya, it would be."
"Councillor Braden on #12."
Braden : "Thank you, Mr. Mayor. If necessary, at the appropriate time, I'd like to make a Motion that for the, starting now, for the naming of facilities or other businesses the City may have - "
Mayor DiIanni : " - From having that Committee look at it?"
Braden : "Well, no, that Committee, but it needs to get going right away so we don't have anymore surprises."
Mayor DiIanni : "Yup, I think that's the intent."
Braden : "And secondly, I think when we do these things, for all of the best intentions - if there is a cost involved, and I can only think, well maybe we're going to put a new sign up. A little bit of thought should go with that and that, in fact, should be in the report. I'm not going to ask that now, but I certainly want to ask that next time, because we don't want surprises later on."
Mayor DiIanni : "Fair enough. Any other comments on #12? I can tell you that, having sat next to Pat when he volunteered to Chair for the St. Joseph's funding drive - and that was, I think, the day after that you met with him - he's honoured, obviously, to accept this honour."
"There is an issue around process and we need to deal with this going forward. All in favour of 12?" (hear councillors say carried) "Carried."
"Councillor Collins, you have a Motion to lift Item (h) from the report and renumber it as Item 13 - or is that the one we just did?"
Collins : "Nope, another one."
Mayor DiIanni : "Okay."
MOTION TO LIFT FROM TABLE - " (h) Proposed Lease with Trustees of the Hamilton Waterfront Trust 47 Guise Street, Hamilton (PW04134/PD04322) (Ward 2) (Item 9.2)
The Committee asked various questions of staff respecting the details of the proposed lease.
(a) On a motion moved by Councillor Ferguson and seconded by Councillor Braden, Report PW04134/PD04322 respecting a proposed lease with the Trustees of the Hamilton Waterfront Trust at 47 Guise Street, was TABLED until an audited financial report of the Hamilton Waterfront Trust is presented to Committee.
The Committee approved a motion requesting that all outside boards and agencies be required to submit financial statements. (See Item 6.) "

Collins : "Moved by myself; seconded by Councillor Ferguson that: 'Information [Section, Item] (h) of the Public Works, Infrastructure and Environment Committee Report 04-021 respecting Proposed Lease with Trustees of the Hamilton waterfront Trust, 47 Guise Street, Hamilton be lifted from the table.'"

Ferguson : "Speaking of that, Mr. Mayor, I got, we all received the Finance Report. I'd like to thank him for that. There are a couple of questions. But, the, I can, they can be addressed at the Standing Committee or on one-on-one with the Chair. Thank you."
Mayor DiIanni : "Thank you, very good. And yes, that information came very, very quickly, as well. On 13, then, all in favour?" (hear councillors say carried) "That's carried."
