COUNCIL AGENDA
Call to Order:
Mayor DiIanni : "Good evening Members of Council; ladies and gentlemen; staff, members of the press. I'd like to call this meeting of City Council to order and ask that you remain standing for the singing of the National Anthem."
National Anthem
Prayer
Mayor DiIanni : "Thank you. I would like, now, to ask Reverend Allison Barrett, Minister of First Unitarian Church in Hamilton (http://www.firstunitarianhamilton.org/), to lead us in prayer."
The Reverend Allison Barrett : "Before we begin the work to which we have given ourselves, this evening, let us pause to give thanks for the many Blessings that are ours."
"Let us give thanks for: the gift of opportunity, for our free and democratic process, that allows each person in our city to think and vote for themselves. For the honour of being asked to serve our human community - and let us ask for the wisdom and the understanding to do it well."
"Let us give thanks for: the gifts of past learning; for those who have come before us; for the work already accomplished within these walls upon which we will build."
"And, let us ask for the vision to link the past, present and future of this wonderful community in which we live."
"Let us give thanks for the support of family and friends that make this work possible. Let us pledge to be a help and support to each other in all the times of our lives."
"And, amid the reality of our daily challenges, let us remember the idealism that first called us into service. May we serve our beloved community with the best that is in us. Amen."
Mayor DiIanni : "Thank you, Allison. And, as Allison leaves because she is attending a meeting. Se me just thank her for the prayer and acknowledge he fact that First Unitarian and we - please sit down (Council and gallery had continued to stand after the National Anthem, so now they sit, and hear giggles) - Sorry about that. The First Unitarian Church is a Church that we've been to many, many times, Allison."
"And, congratulations to you and your congregation. It's not only a Church with a tremendous diversity, but one that is committed to social justice and activism and lots of good things happen there. So, congratulations and thank you."
1. Approval of Agenda
(Pearson / Whitehead - CARRIED as Amended)
Mayor DiIanni : (Mayor pauses and smiles) "Actually, stand up - no, no, I'm just kidding. (hear giggles from Council and gallery) Mr. Clerk, are there any changes to the Agenda?"
Kevin Christenson - City Clerk : "Yes, thank you, Mr. Mayor. We have a change to the presentation section, tonight. Presentation of the Sustainable Community Awards has been deferred to the October 26 th Council meeting. In its place, we will have a presentation to the 'Teen Tobacco Challenge Awards.'"
"We have added reports:"
"The Committee of the Whole Report 05-015, from the Special Meeting held this afternoon. Although it's being added as Item 6.5 to this evening's agenda, we are moving it up to be the first report for consideration, this evening."
"We have 2 private and confidential added items:"
"The first is respecting a labour relations matter to be added as 10.1. This issue remains outstanding from the Planning and Economic Development Committee meeting held on September 20, 2005 . It is referenced as Item (u) in the Information Section of this evening's report;"
"The second is a personnel matter."

"Added Motion 7.4 by Councillor Ferguson respecting Big Creek Estates, which was also tabled by Council at its last meeting;"
"And, added Motion 7.5 by Councillor McHattie respecting Social Services downloading."
Mayor DiIanni : "Thank you very much, Mr. Clerk. Members of Council, I need a verbal Motion to approve the Agenda as amended. Moved by Pearson; Seconded by Whitehead. All in favour?" (hear councillors say carried) "That is carried."
2. Declaration of Interest
Mayor DiIanni : "Members of Council, are there any declarations of interest?"
3. Ceremonial Activities
Mayor DiIanni : "Seeing none, we're going to move to Ceremonial Activities."
3.1 Presentation - 2005 Commuter Challenge
Mayor DiIanni : "The first of which is the 2005 Commuter Challenge awards. And, our first presentation is the, is exactly that - the awards for that. And, I would ask Heather Donison of Green Venture (http://www.greenventure.ca/gv.asp) to join me at the podium for the presentations. Welcome Alison. And, as she's - or Heather, rather. And, as she's coming up, I'm just going to tell you that the Commuter Challenge aspires to reach 2 goals. And, in particular, they are first:"
"To ensue that the City of Hamilton has the best air quality of any major urban area in Ontario ;"
"And 2, to encourage a shift in personal lifestyle and behaviour towards transportation choices that enhance personal health and fitness, save money, and have the lowest environmental cost."
"This year, Hamilton placed 4 th in the National Commuter Challenge, moving up from its 2004 5 th place position, for its category - which is population under 500,000"
"1, 915 participants from Hamilton joined the commuter challenge this year, reducing single occupancy car trips by over 162,000 km - a number higher than many of Canada's larger cities, including Toronto and Montreal."
"28 Hamilton-based organizations and hundreds of individual residents committed to change their commutes during Environment Week. Winning organizations based on the percentage of participation among employees were: McMaster University; Mohawk College; Hamilton Utilities Corporation; the Economical Insurance Group; the Hamilton Community Foundation; and Was-a-bike - Wazabike."
"At this time, I'm going to invite Heather to address you and invite the award recipients to the podium - and you'll do that? [asks this question of Heather Donison] Invite them to the podium?" (hear Heather Donison off microphone agree to this)
Heather Donison (General Manager, Green Venture): "Thank you, Mr. Mayor. As an environmentalist, it is easy to become discouraged about the future, the cumulating affect of greenhouse gas emissions on out earth and toxic air emissions on our community's health is serious. Business as usual is not an option."
"Our daily habits, such as commuting, have a major impact on the environment and air quality. However, today we are here to celebrate and recognize some successes. Today, community and government are creating measurable actions and building momentum to reach Canada's Kyoto commitment and to reduce local toxic emissions."
"Changing citizens' transportation behaviours is a challenge. It starts with education and understanding at the community level and is supported by developing sustainable community infrastructure at the municipal and regional level."
"Tonight, we are recognizing organizations that have taken on the challenge of encouraging their employees to try alternatives to the drive alone commute."
"The winning organizations were chosen based on the percentage of participation among employees in their organizations. However, all of the participating have taken their corporate responsibility seriously in entering into this community effort. And, I would like to thank all of them for this."
"Tonight we are recognizing winners in 6 organizational categories."
McMASTER UNIVERSITY
"The first we are going to recognize is McMaster University, with a population greater than 1,000."
"McMaster University out-performed not only among large organizations in Hamilton, but across Canada in their size category. For the second year in a row, McMaster University had 1,115 staff and students this year. The participants travelled more than 100,000 km by active and sustainable means. The combined efforts of McMaster's campus community saved a total of 20 tons of gas emissions during Environment Week."
"The Alternative Commuting and Transportation [ACT] (http://act.mcmaster.ca/) Co-ordinators - Jennifer Dawson and Daryl Bender - organized a week high-lighted by a sustainable transportation fair; a celebration of Clean Air Day; bike repair workshops and many more events across campus."
"Several participants also gave up their parking permits for the entire summer, helping to reduce the number of cars on campus. So, I'd like to invite Jennifer Dawson and Daryl Bender to come down and receive their award." (hear applause from Council and gallery)
Daryl Bender (ACT office - McMaster ) "I just want to say one or two quick things. First as a staff of McMaster University, that we worked really hard on it and were really proud of it. And, we look forward to working with the HSR to get more transit service to and from campus, as it's so strongly needed."
"But, secondly, as an individual of this city, I just want to draw your attention to those mugs on your tables, just to mull over some of those ideas about ramping up just that much more rapid transit service in this city, as well. Thank you very much." (hear more applause from Council and Gallery)
MOHAWK COLLEGE OF APPLIED ARTS AND TECHNOLOGY
Heather Donison : "The next award winner is also a post-secondary school. Mohawk College with a population between 500 and 1,000. This was the first year that Mohawk College participated and achieved great results."
"The 157 staff and students who participated travelled a combined total of over 7,000 km during the week of the challenge. Their efforts prevented an equivalent of 1.6 tons of greenhouse gases from entering the atmosphere."
"Mary Rich - I don't know if she came in later. She was hoping to be here. But, if she's not here, we will get her award to her."
HAMILTON UTILITIES CORPORATION (now Horizon Utilities Corporation)
Heather Donison : "The next winner is Hamilton Utilities Corp., which was the name they were using when they participated - now Horizon Utilities Corp."
"Horizon saved 1,658 km of road travel through the efforts of 54 dedicated employees who demonstrated their corporate values. Horizon Utilities strives for a balance of financial goals with their social, environmental objectives. They were very enthusiastic and are interested in further involvement in setting an example in the community by participating in more permanent reduction programs."
"Valerie McKenna is here for Horizon Utilities to accept the award." (hear applause from Council and gallery)
ECONOMICAL INSURANCE GROUP
Heather Donison : "With a population between 100 and 200, the Economical Insurance Group saved 962 km of travel. Employees from the Economical Insurance Group across country engaged in participation in the Commuter challenge. And, branches competed within their corporation for prizes and recognition. Sheila Boyd is here, on behalf of Economical Insurance to accept the award." (hear applause from Council and gallery)
HAMILTON COMMUNITY FOUNDATION
Heather Donison : "And, with a population between 25 and 100, the Hamilton Community Foundation, once again, committed to this week-long event. They saved 997 km - almost 1,000km - receiving and award for their out-standing efforts."
"Linda Hughes will accept their award." (hear applause from Council and gallery)
WAZABIKE
Heather Donison : "And finally, with actually only 1 employee, in the population under 25 category: Wazabike had 100% participation." (hear giggles from Council and gallery) "And, but managed a very impressive result this year as he commuted 333 km by recumbered bicycle during Environment Week. This - " (hear applause begin from Council and gallery) " - prevented the creation of almost 100 kg of pollution."
"Rob Wazny is here to accept the award." (hear applause from Council and gallery)
Mayor DiIanni : (thanks Rob Wazny off microphone) "And thank you, for doing this each year, Heather, and promoting the Commuter Challenge. And, also acknowledging the many people who contribute. And, I know that we had almost 2,000 participants and hopefully next year it'll be 4,000."
"Just so you know, that I did my little bit. I did take the bus from Stoney Creek into work during that week. And, - " (hear applause from Council and gallery) " - Thank you. Well, I'll tell you a funny story. It was fun; I enjoyed that, and got a chance to talk to people. But, the first question I was asked was: 'Why are you taking the bus?'" (hear giggles from Council and gallery)
"And, after I explained to the bus driver, that it was good service, we chatted and managed to come here. So, it was great. Thank you for doing this." (hear Heather Donison off microphone say 'Thank you;' followed by applause from Council and gallery)
3.2 Presentation - Teen Tobacco Challenge Awards
Mayor DiIanni : "And, the second ceremonial award is the Teen Tobacco Challenge Awards."
HealthandSocialServices/PublicHealth/Tobacco/Prevention.htm),
(http://unfilteredfacts.ca/gallery/pdf/TTC.pdf)
"I would like to ask Andrea Kita, Aaron Puley, Ricky Stevens, and Councillor McHattie, actually, to join me at the podium. And, as the they're doing that, the 5 th Annual Teen Tobacco Challenge was held between April and June of 2005. And, students could enter in groups with 2 or more students."
"The entries must have been completed in one or more of the following categories:"
- "The decrease in the selling or the buying for or giving tobacco industry products to minors;"
- "The provision of support for teens who wanted to quit using tobacco industry products;"
- "A reduction in youth exposure to 2 nd hand smoke;"
- "The spread of unfiltered facts about the tobacco industry's manipulation and lies;" - "who wrote the script for me?" (hear giggles from Council and gallery)
- "And, support for the removal of the tobacco industry's power wall."
"The group 'S.T.O.P.' - S - T - O - P, and we can see the t-shirts - " (hear giggles from Council and gallery) " - 'Stop Tobacco at Orchard Park' - (O.P.) (http://webserver.hwdsb.on.ca/about_us/newsroom/
v_2_0_1/news_detail.aspx?newsid=564 ) which is a school in my neighbourhood, a school out of which my own son graduated - was awarded the best over-all entry - in your neighbourhood, too, Councillor." (not sure to which Councillor he was referring)
"The students at O.P. were very creative when the launched 'Operation Chalkboard,' and a campaign against big tobacco. And, the great messages written on over 20 chalkboards throughout the school."
"Students were late the night before and early, the next morning, to have messages in place for students who were arriving to class. Other initiatives included circulating a petition: gathering support for the Government of Ontario to remove 'Power walls' of tobacco behind the counter of every gas station - oh, I see, the 'power walls' where they sell -. Ya, okay, I get it." (hear giggles from council and gallery) - every gas station, corner store and grocery store."
"Creating t-shirts to provide a constant visual presence throughout the school raising awareness about their group's mandate."
"Developing the 'Band Together' campaign with messages about the effects tobacco and cancer that were played on weekly morning announcements and flyers - and presented in flyers around the school."
"And so, I'm very pleased, that on behalf of our Council we're going to recognize the achievements of Orchard Park students. And, I ask them to be acknowledged as I present the certificate. And, I invite anyone of Andrea, or Rickie or Aaron to, perhaps, briefly address Council. And, maybe all 3 of you." (Mayor turns to the 3 recipients) "Want to do that? And, we'll give Councillor McHattie a chance, as well."
Ricky Stevens : "STOP is very proud to accept this award because of what it represents. To us, it means that somebody outside of the anti-tobacco community is listening to our message and becoming aware of what tobacco companies are doing to sell their product."
"We look forward to continuing our campaign, this year. And, hope that you continue listening." (hear applause from Council and gallery)
Aaron Puley : "I just want to say that it's a honour to be recognized here, this evening, for the achievements of the STOP Tobacco at Orchard Park Committee and for all the hard work that they did, last year. They really did do a lot of work."
"And, I know, as staff at Orchard Park, I can speak for all of us at the School when I say, that we are very proud of their accomplishments and everything that they did. - and enthusiasm that they showed while they did it. It was just absolutely fascinating and awe-inspiring. It's not about us; it's about them. And they really deserve all the credit. So, I want to thank you." (hear the Mayor off microphone say 'nicely said.') "Thank you, very much." (hear applause from Council and gallery)
Andrea Kita : "On behalf of the Teen Tobacco Summit Planning Committee that has been responsible for the last 5 years, planning an annual summit for our student, like Ricky and her friends at Orchard Park, to come and get the knowledge and skills to take on tobacco control issues, we're very proud of their efforts. And, we look forward to any future entries they might have in the next Teen Tobacco Challenge." (hear applause from Council and gallery)
McHattie : "And, just on behalf of the Social Services and Public Health Committee, a particular thanks as we're focused on lots of anti-smoking issues and non-smoking issues."
"And, I guess, just on a very personal basis, my sister died about a month ago, of lung cancer. And, she started smoking when she was about 15 years of age - and, that's when kids often start smoking - and, of course, never stopped. So, that's a very difficult situation for my family. But, many others in the same situation."
"So, the work that you're doing at Orchard Park and other high schools throughout Hamilton is particularly important to stop children from smoking at that age. And hopefully, avoid any illness later on. So, a very personal thank you to, for what you've done. Thanks." (hear applause from Council and gallery)
Mayor DiIanni : "And, as they're taking their seats, I just want to acknowledge the other students from Orchard Park, as well. Please stand and be acknowledged." (hear applause from Council and Gallery) "Thank you for being here. Well done. Thank you very much."
