COMMENT ON - Information Section Item " (f) Temporary Closure of Hess Street South between George Street and King Street for a Halloween Street Festival (PW05116) - (Ward 2) (Item 5.2)
Councillor Bratina expressed concerns with the Hess Street late night operations. He has received numerous complaints about loud music being played beyond 11:00 p.m., the City parking lot not being cleaned up after an event, and the requisite police fees not being paid. The operators are not following the rules and owe money.
At the request of Councillor Bratina, on a motion (Ferguson/McCarthy) the Committee TABLED the report in order to allow the Ward Councillor time to consult with the interested parties (residents, bar owners, police, etc.)."
Bratina : "We did, in fact have a, quite a meeting last night, here, that over-flowed into the Council Chambers. We had about a 100 residents. A number of the bar owners, Police and staff."
"And, we agreed that staff would come forward with a report on how to conduct business in Hess Village , sometime before the end of the year, and present it to all those parties. But, in the meantime, the request for the street closure was withdrawn. And so, we'll be able to move forward in the year 2006, I think, in a much clearer way, in terms of making sure - ensuring that Hess Village and its activities, continue to be an asset for the City. Thanks, Mr. Mayor."

REQUEST FOR CLARIFICATION - " 5. Sanitary Sewer Construction - Windemere Road and Shippee Avenue (PW05113) - (Ward 11) - Outstanding Business Item Z of the Public Works, Infrastructure & Environment Committee Agenda of September 12, 2005 (Item 8.1)
(c) That should the installation of sanitary sewers on Shippee Avenue and Windemere Road proceed in accordance with recommendation (a) of Report PW05113, the General Manager of Finance and Corporate Services be authorized and directed to prepare the Municipal Act cost recovery by-law for the recovery of capital costs of the construction of the sanitary sewer extension on Shippee Avenue from McCollum Road to Windemere Road, and on Windemere Road (north-south and east-west sections) from the benefiting properties as outlined in Appendix "A", attached hereto, at the time of completion of construction."
Braden : "Mr. Mayor, can I just have it through you, clarified, on page 4 of the Public Works when it talks under 5(c ), it talks about recovery of Capital Costs. Am I to understand, that means full recovery of costs - because, there's a big difference."

Whitehead : "Thank you, Mr. Mayor. I just wanted to - this has been a long-standing issue in Ward 8. It's an area that's currently under-serviced. It's, it, they're on septi . " (tape stopped, sorry) ". that what this report in front of us states, is that the City will be pursuing an expropriation for the easements, so that we can finally get water and sewer up to that part of the community."
"So, I want to thank, again, the staff that worked on this report. Thank you."

a) That Report PED05105 respecting the proposal to issue a Request for Information (RFI) - Joint Venture Agreement for the Development of a Parking Structure in the Downtown Hamilton Community Improvement Project Area (DHCIPA) be received for information.
b) That staff of the Hamilton Municipal Parking System (HMPS) be authorized to issue a Request for Information (RFI) to gauge the level of interest from the private sector to participate with the HMPS in the development of a parking structure.
c) That staff report the results of the Request for Information (RFI) at a future meeting of the Planning and Economic Development Committee.
d) And that HSR be requested to comment on the relationship between transit use and the availability of parking Downtown, and that their comments be included in the staff report to Committee."
Whitehead : "Mr. Mayor. I just want to comment. And, that's something that seems to be missing. And, I had asked this - cause I think Councillor McHattie has raised an issue in regards to the capacity issue and that whole - the staff looking at joint ventures for a potential parkade development in the downtown, because there is a capacity issue. And, talked about getting HSR involved in respect to their comments."
"What's not here - that's part (d) of the recommendation, too - what's not here is what I had asked for that was, assume that'll be part of the process, is the fact that the BIAs [Business Improvement Area] and the merchants should be also involved in discussion in respect to this particular process. So, I just want to know, what happened to that particular recommendation."
Mayor DiIanni : "Scott, can you comment on that? Anyone?" (hear someone say something off microphone)
Scott Stewart - General Manager, Public Works : "Certainly, the HSR component, I'll speak to and I'll hand this back to Lee Ann [Coveyduck]. We are being requested to comment on that. And, staff are participating with the Planning staff. And, we'll give them the comments. But, the rest of it - "

Lee Ann Coveyduck - General Manager, Planning and Development : "Yes, in terms of the BIA, that's a process issue. And, definitely, they'll be part of the consultation. That was always intended."
Whitehead : "Well, I guess, then, the question is, does that mean that the HSR was always part of that consultation, too. Or, the reason why we added HSR is because they're not part of that consultation?"
Lee Ann Coveyduck - General Manager, Planning and Development : "HSR'll be part of the consultation. But, adding it didn't harm anything; just reaffirmed it."

That the Real Estate Section of the Development and Real Estate Division be authorized and directed to advise the Hamilton-Wentworth District School Board that the City of Hamilton has no interest in acquiring the lands composed of Lot 30 on Registered Plan M-3, save and except Part 1 on Plan 62R-1522, municipally known as 12 Ambrose Avenue, Hamilton, as shown on Appendix "A" to Report PED05121."

"And, I've received a number of calls from the surrounding community who are anxious to know what's going to happen with the school property in regards to future development - and, I would add, I think one of the complaints that I've passed along to the joint committee that we have, is that there seems to be a lack of communication to surrounding neighbourhoods once schools are declared surplus and are put up for sale."
"I would just suggest that we add a part (b): 'that the City of Hamilton request and encourage the Hamilton-Wentworth Catholic District School Board to communicate to the surrounding community, the process related to the disposal of the property at 12 Ambrose' If I could."

COMMENT ON - " 8. Application for a Change in Zoning for Lands Located South of the Lincoln M. Alexander Parkway and West of West 5 th Street (Hamilton) (PED05114) (Ward 8) (Item 6.1)
That approval be given to Zoning Application ZAC-05-56, 1419690 Ontario Inc, (Ward Campbell), owner , for a change in zoning from "DE" (Low Density Multiple Dwellings) District, Modified, to "R-4" (Small Lot Single Family Dwelling) District, Modified (Blocks 1 to 3) to permit the development of 12 interlink single detached dwelling units and from "DE" (Low Density Multiple Dwellings) District, Modified to "R-4" (Small Lot Single Family Dwelling) District, Modified (Block 4) to permit the development of 18 small lot single detached dwellings, for lands located south of the Lincoln M. Alexander Parkway and west of West 5 th Street (Hamilton), as shown on Appendix "A" to Report PED05114, on the following basis:
(a) That Blocks 1, 2 and 3 be rezoned from "DE" (Low Density Multiple Dwellings) District, Modified, to "R-4" (Small Lot Single Family Dwelling) District, Modified.
(b) That Block 4 be rezoned from "DE" (Low Density Multiple Dwellings) District, Modified, to "R-4" (Small Lot Single Family Dwelling) District, Modified.
(c) That the Draft By-law, attached as Appendix "D" to Report PED05114, which has been prepared in a form satisfactory to Corporate Counsel, and as amended by Committee on September 20, 2005 with regard to minimum rear yard depth and landscaped open space areas, be enacted by City Council.
(d) That the proposed changes in zoning are in conformity with the Official Plan for the Hamilton Planning Area."
Braden : "Mr. Mayor, through you, to whoever can answer. Can somebody comment on what the change in density is. And maybe define what the word 'interlink' means. And, I ask these questions - the staff are saying off of the record to me, you know, if you keep reducing density, the chance it's never going to work and this thing's never going to be sustainable."
"And, we seem to keep doing this. But, maybe I'm misunderstanding. So, can staff comment about if the density per acre, or per hectare, is changing on this particular proposal?"
Mayor DiIanni : "Staff first."
Braden : "Please."
Lee Ann Coveyduck - General Manager, Planning and Development : "Yes, though you, Mr. Mayor. On 2 of the blocks, there is no density change. However, on blocks 1 to - er, on block 4 there will be a density change. And, that'll be 18 units less in the overall development."
"And, in terms of your other question, I almost have to be able to draw a diagram. But, the inter-linking lots are actually like a U-shaped lot that attach together. It's very difficult to explain without showing the diagram. But, it does allow for a little bit of innovation in higher density development, as part of that."
Braden : (starts to speak without microphone on) ". is that I'm hearing that we're getting - are we getting 18 units less?"
Lee Ann Coveyduck - General Manager, Planning and Development : "What we're doing is they're looking at changing the form of development. So, it'll be single-family development. So, the single-family lots are higher density than typical family lots. But, not as high density as what the townhouses would have been."
Braden : "Mr. Mayor, if there's a simple answer to this. Is the Planning Department interested on maintaining the sort of the density that's in the plan; increasing the density, or lowering it. Is there a simple answer because regularly we see developers trying to get less density. And, I'm sure - I'm supposing that that's not the professional planner point of view."
"So, can I - if the staff are recommending this, can I understand why?" (hear someone say something off microphone)
Lee Ann Coveyduck - General Manager, Planning and Development : "Yes, it's - "
Braden : "Staff want higher density; developers want less - normally."
Lee Ann Coveyduck - General Manager, Planning and Development : "Through you, Mr. Chairman. Typically what we do, is we often look at each application on its individual merits. When we looked at this particular application and looked at the density in the surrounding area, looked at the innovative type of housing that was being provided. And, we looked at the design guidelines for that particular neighbourhood plan. We felt that this did fit with that particular plan. And, for that reason, we recommended in favour. And, I believe some of the additional rationale is included in the report."
Braden : "Mr. Mayor, not to prolong this, but to make a statement about this. If, you know, with this whole urban boundary discussion and Greenbelt . And, I think we were saying we're going to take 40% and we're going to do it through intensification. It would seem to me that we should start now, rather than establishing - as soon as you establish this, we're not going to increase this density as soon as it's built."
"So, I think sooner of later, we - the knife has to fall. And, we have to say whether or not we're committed to raising densities. That's the purpose of the interchange. Thank you."
Mayor DiIanni : "And, Councillor Whitehead."
Whitehead : "Thank you, Mr. Mayor. And, I can guarantee to the former Councillor - the former Councillor who spoke - that the density in this neighbourhood is probably 5, 6 times more than anything in his Ward. The reality is, is that this is one of the most dense subdivisions in Ward 8."
"I can also suggest very strongly, that in this particular development, that the density is far beyond what I believe, and the community believes, is that traffic can bear in regards to the routes and the roads."
"This decision - I met with the developer - was based on - not because they didn't want to create townhouses at this particular location - but it's the configuration of the land that made it very difficult to do anything in respect to the townhouses."
"So, it's my understanding that they were committed to doing the higher density. But, because it's next to the Linc [ Lincoln Alexander Parkway ] it created a bit of a problem for them in the actual development."
"But, I want to make it absolutely clear that this is one of the most dense neighbourhoods, currently, in Ward 8. And, I wouldn't want it anymore denser. Thank you."
Mayor DiIanni : "And, Councillor McHattie."
McHattie : "Sorry, Mr. Mayor, I'll be very brief, because I just wanted to reiterate that same point. We asked that question at Committee. And, I wasn't sure - the answer today was a bit different, I guess. Maybe the question was phrased a bit different. But, it is sort of the layout of the land, in that area."
"We're always concerned when we see density go down and we're trying to get more density in terms of Places to Grow at the Provincial level - the new GRIDS process. But, it was a case of how the land was configured and the Linc being right in that area, as well. So, I just wanted to support Councillor Whitehead's comment."

COMMENT ON - " 10. Clean Up of 1759 Safari Road (PED05113) (Ward 14) (Item 8.1)
a) That staff be authorized and directed to pay Power Property Services $42,800 for performing the work of removing rubbish and debris from 1759 Safari Road pursuant to the Property Standards Order, which became final and binding September 30, 2004.
b) That staff further be authorized and directed to exceed the amount outlined in sub-section (a) above by 10%, in order to respond to any additional unforeseen changes in the property's condition.
c) That charges for the clean up of 1759 Safari Road , as outlined in sub-sections (a) and (b) above, be added to the property's Tax Roll 30171053200.
d) That the lowest bidder, Power Property Services be awarded the contract to remove rubbish and debris from 1759 Safari Road .
e) That Public Health staff be directed to test wells within the vicinity of the subject site as soon as possible and report back to Committee regarding any recommended remedial action required."

COMMENT ON - " 13. John C. Munro Hamilton International Airport - Updated Noise Exposure Forecasts (PED05119) (Ward 11 & 12) (Item 8.3)
(a) That the City of Hamilton request Transport Canada to assist City staff and their agents to update the John C. Munro Hamilton International Airport Noise Exposure Forecasts/Projections and related contours.
(b) That $45,000, representing the City of Hamilton 's 50% share of the total cost of revising and updating the John C. Munro Hamilton International Airport Noise Exposure Forecasts/Projections and related contours, be funded from the City's Development Charge Studies Reserve #110324.
(c) That the General Manager of Planning and Economic Development Department retain the services of a consultant to update the Noise Exposure Forecasts/Projections and related contours in accordance with the City of Hamilton Purchasing Policy."
Mitchell : "Just a quick comment, Mr. Mayor. I'm supporting this very much. But, I still get the odd phone call about noise. And, I know the noise committee is in place to be called, a couple times a year. And, I've sent a letter from my office to the Airport staff at TradePort to just to request that the pilots stay on the flight paths, and don't turn too soon, because sometimes that creates noise over houses that have never had noise before."
"So, it's just a concern that's come from my Mount Hope community. And, that request has gone in. And, I do strongly support this."

(a) That approval be given to amended Official Plan Amendment application , OPA-05-01 by 1622141 Ontario Limited (Helmuth Strobel) owner , for land located at 125-139 Wilson Street West (Ancaster), as shown on Appendix "A" to Report PED05074, for a change in designation on Schedule "B", Land Use - Urban Area of the Town of Ancaster Official Plan, from "Institutional" to "Residential" and to add a special policy to permit 4 occupied stories entirely above the grade level.
(b) That approval be given to amended Zoning By-law Amendment application ZAC-05-03, 1622141 Ontario Limited, (Helmuth Strobel), owner, for a change in zoning for lands located at 125-139 Wilson Street West, from the Institutional "I" Zone to the Modified Residential Multiple "RM6-530" Zone, to permit a 59 unit, 4 storey apartment building, as shown on Appendix "A" to Report PED05074, on the following basis:
(i) That the zoning of the subject lands be changed from the Institutional "I" Zone to the Modified Residential Multiple "RM6-530" Zone.
(ii) That the attached Draft By-law, shown as Appendix "B" to Report PED05074, which has been prepared in a form satisfactory to Corporate Counsel, be enacted by City Council.
(iii) That the proposed change in zoning will be in conformity with the Town of Ancaster Official Plan upon approval of the proposed Official Plan Amendment."

McHattie : "Thanks, Mr. Mayor. I just wanted to thank staff very much for pursuing this. These are brand new schools. And, we have the opportunity to put naturalized areas, butterfly gardens, ecology gardens - students can learn about ecology right on the school."
"So, I want to thank our staff for pursuing that with the school boards. The best time to put these in is when the school is actually first created, rather than trying to retrofit later on."
"So, a lot of hard work. Staff didn't know very much about this idea and they did a lot of reading and a lot of background work. And, they worked very successfully with the boards to get the naturalized areas in place. So, thanks very much to our staff."
Mayor DiIanni : "When I read this in the report, I thought what a great, what a great idea. And, having administered a number of schools, I hope that the school board, once this is implemented, finds a champion - and, I'm sure they'll be able to do that - within the school, to sort of integrate it into the curriculum because it's extremely important. And, I'm sure that you and others might be helpful in doing some in service. And, what that means, in case there isn't local expertise there - otherwise it'll not have the result that is wanted." (hear a glass clink)
"On 15, again, as well?" (Hear someone say something off microphone) "Councillor Samson, first."
Samson : "Thank you, your worship. I'd just like to back up to 14, because I believe, I heard Councillor Ferguson say that he was opposed to that."
"And, it takes me back - I was at the particular meeting - I'm not a member of the Committee, but I was there. I thought that it was going to be taken back and they were going to try work out some type of a resolution."
"So, this is the resolution. And, I'm hearing the Ward Councillor is not for this. Is that what I'm hearing?"
Mayor DiIanni : "I think - well, we've already voted on 14. It's been approved. But, yes, the Ward Councillor voted against it." (hear a glass clink)
Samson : "Okay. Well, I want to be against it, too." (hear some giggles from Council and gallery)
Mayor DiIanni : "All right, we just voted on it." (hear a glass clink) "But, we'll record you as: 'opposed,' as well - and Councillor Mitchell - 3 of you. All right."
"#15, then?" (hear councillors say carried) "That's carried, #16?" (hear councillors say carried)
"Members of Council - " (hear a glass clink) "We will temporarily table this report, until we've had our in camera session. And, then we'll come back to this. Okay. So, we won't approve just now. Go ahead, Councillor."
Whitehead : "Can I just speak to - I guess it's Information. We talked about, we already passed the, the school board issue in regards to the 'in lieu of' - the park dedication. But, there was a further discussion at the Planning and Development Committee in respect to collaboration and dialogue with the school boards."
"And, there was certainly a news article that came out of that particular meeting - it's echoing, here - (Councillor's microphone has a bit of feedback) and I just want to provide clarification, that I think that there's a real advantage."
"And, I know that through the leadership of Councillor Ferguson on the School Liaison Committee - and I have talked to a number of the Trustees subsequent to the article - that I am in full support, and that I know we are on some fronts working very well together, cooperatively. But, we need to have much more dialogue, because so much more needs to be done; can be done through economy of scales of dollars for the tax-payer can be saved."
"And so, to me, I'm in full support of the Board sitting down with us and having that discussion and working collaboratively. So, I just wanted to make that point. It's about working together."
Mayor DiIanni : "Thank you very much."
