Mayor DiIanni : "Good evening Members of Council, ladies and gentlemen. And, welcome to our Council meeting in Ancaster. I would like to call this meeting to order."

"This meeting is the fourth in a series of Council meetings which we've been conducting in the former area municipalities."

"And, I'm pleased once again to welcome all of Council, staff and members of the public who have joined us, this evening in the beautiful community of Ancaster. And, I ask everyone to please remain standing for the singing of the National Anthem."

Mayor DiIanni : "Thank you very much. Please be seated. Ladies and gentlemen - can you hear back there?" (hear answers from gallery) "Yes and no. How's this?" (hear people say 'that's better') "All right."

"Ladies and gentlemen, Members of Council, I would now like to welcome Father Dan Miehm of St. Ann 's Roman Catholic Church in Ancaster. (http://www.st-anns-ancaster.com/) Father Miehm, who is at the microphone, was born in Kitchener - gosh, it says you're year of birth, here, Father Miehm, such a young person, 1960. And, attended elementary and secondary school in that city."

"He graduated with a Bachelor of Arts degree from the University of Waterloo , St. Jerome 's college, in 1982. And, after receiving his Master of Divinity in 1989, from St. Augustine 's Seminary in Toronto , he was ordained a Priest for the Roman Catholic Diocese of Hamilton. He served as Associate Pastor at my own Parish of St. Francis Xavier Church in Stoney Creek

Mayor DiIanni : "Of course, that was the world famous [ Hamilton ] All Star Jazz Band. And, we thank them. They're always most entertaining and very accommodating, as well. Thank you for bringing that also."

3.1 Presentation by Rotary Clubs to the City of Hamilton

Mayor DiIanni : "I'd like to invite John Mullin and Jan Bradley (http://www.ancasterrotaryam.com/) to the microphone for a cheque presentation, please. John and Jan. And, I'm going to actually have Councillor Ferguson introduce this item."

Ferguson : "Thank you, Mr. Mayor. When this facility was built - I guess, now, in 1998, that's when we were doing fundraising - the Rotary Clubs, jointly pledged a half a million dollars toward it. The Rotary Clubs jointly pledged a half a million dollars towards this project - that's $25,000 a year. This installment, this year makes it so we've reached, or we're over the halfway point. And, so Jan is - or John, is President of the AM - or PM Club. And, Jan is President of my favourite Club, the AM Club." (hear giggles from Council and gallery) "John and Jan." (hear applause from Council and gallery) (John Mullin and Jan Bradley present cheque to Mayor DiIanni)

QUESTION on Item #15 - " 15. Parking Issues in Downtown Hamilton (PED05019/SPH05038) (Wards 1, 2 & 3) - Referred from Planning and Economic Development Committee on August 3, 2004 and City Council on January 26, 2005 (Item 7.1)

(a) That the following recommendations be forwarded to the 2006 Budget process:
(i) That consideration be given to allocating $200,000 to the Public Health and Community Services Department Budget to allow for the interim financing of the York Boulevard Parkade "one-hour free parking" program, as a Cultural Services initiative, until such time as a market analysis respecting the Hamilton Farmers' Market, being undertaken by the Cultural Services Section, has been completed.

(ii) That, contingent upon the allocation of funds as proposed in sub-section (a)(i), above, "no charge" parking on Saturdays at all on-street parking meters within the Downtown Hamilton Community Improvement Plan area be implemented as a Hamilton Municipal Parking System initiative.

(iii) That, contingent upon the allocation of funds as proposed in sub-section (a)(i), above, and the approval of sub-section (a)(ii), above, Hamilton Municipal Parking System staff be authorized and directed to consult with the various Downtown Hamilton Community Improvement Plan area stakeholders to develop a marketing strategy respecting the "free on-street parking on Saturdays" initiative.

(iv) That, contingent upon the allocation of funds as proposed in sub-section (a)(i), above, and the approval of sub-section (a)(ii), above, a by-law in the form attached hereto as Appendix "A" to Report PED05019/SPH05038, be passed and enacted upon the completion of the 2006 Budget process. identified as completed and removed from the Outstanding Business List of the Planning and Economic Development Committee."

Whitehead : "Can I just ask through you, Mr. Mayor to staff, how would this be presented in the Budget process - like, how would - Would this be an enhancement, 1 and 2? When would we be able to have a full debate?"

Joe Rinaldo - General Manager, Finance and Corporate Services : "Through you, Mr. Mayor ." (I couldn't hear the rest of Mr. Rinaldo's answer. However, my notes indicate that it would be a separate enhancement)

QUESTION on Item #17 - " 17. John C. Munro Hamilton International Airport - Federal Zoning Regulations (PED05137) (City Wide) (Item 8.2)

(a) That the City of Hamilton request Transport Canada to revise and update the John C. Munro Hamilton International Airport Zoning Regulations.

(b) That the City of Hamilton request Public Works and Government Services Canada to provide their services with respect to revising and updating the John C. Munro Hamilton International Airport Zoning Regulations.

(c) That $129,000, representing the City of Hamilton 's 50% share of the total cost of revising and updating the John C. Munro Hamilton International Airport Zoning Regulations, be funded from the City's Development Charge Studies Reserve #110324."

Braden : (Councillor Braden starts speaking without his microphone on and still could not hear him when he adjusted his microphone, sorry. But, my notes indicate that the Councillor asked a question about the development charges)

Lee Ann Coveyduck - General Manager, Planning and Development : "Through you, Mr. Mayor, apparently there is Federal zoning restrictions on the Airport lands. These zoning restrictions apply mainly to height. These zoning restrictions are in need of being updated. So, as part of the Federal process to update these zoning restrictions, they look to the municipalities to provide the funding for that."

"Given that we have an association with TradePort, we're going to be cost-sharing the cost of putting new zoning regulations with respect to height on the Airport lands. This is very consistent with the process that we're now engaged in, in and around the Airport for the Secondary Planning process. So, it's going to fit very nicely as part of that process."

"There will be full public participation as part of the planning process."

Braden : (couldn't make out Councillor's first couple of words) " . the significance of height is already sort of endorsed and encapsulated in the present building. And, is this, is this for the future growth. Or, are we re-zoning just the areas that were already settled? Is this all new, or, is this going back?"

Lee Ann Coveyduck - General Manager, Planning and Development : "It would be for both."

Braden : (says something, but couldn't hear the comment, but my notes indicate that Councillor Braden prefers not to have to pay)

Mayor DiIanni : "Okay. All in favour of 17?" (hear councillors say carried) "Against?"

"18" (hear councillors say carried, and also hear another dull knocking noise) "18, go ahead."

QUESTION on Item #18 - " 18. Aeropark Industrial Lands - Extension to the Commencement and Completion of Construction Dates (PED05136) (Ward 11 and City Wide) (Item 12.1)
That the Offer to Purchase the lands known as Part of Lot 5, Concession 3, Township of Glanford designated as Pt. 1, 62R-12209 and Pts. 7, 13, 19, 20, 25, 26 & 27, 62R-12459, municipally known as 2530 Highway No. 6, formerly in the Town of Glanbrook, now in the City of Hamilton, duly executed by the Purchaser,

Orlick Industries Limited, on April 12, 2000 and approved by Regional Council on December 21, 1999 , Item 1 of Report 8-99 of the Economic Development and Tourism Committee, be amended as follows:

a) That Clause 8.7 - the commencement of construction date be extended from September 2, 2005 to May 2, 2006 .

b) That Clause 8.8 - the completion of construction date be extended from September 30, 2006 to May 30, 2007 .

And that the balance of the report remain confidential "

Braden : "It says at the end of this report that I think we struck this deal back in 1999. And, ." (couldn't hear the next couple words of Councillor) "it looks like we're putting this off at least for, perhaps, another year. Are the ." (couldn't make out the Councillor's next couple of words) "of the deal somewhat the same. You know, can we just sell this for the same value we agreed to in 1999?"

Mayor DiIanni : "I'll have staff respond to that. I understand that the land is sold. It's not a question of selling it, it's just extending the construction component."

Lee Ann Coveyduck - General Manager, Planning and Development : "That is correct, Mr. Mayor, we are not changing the terms of the sale other than to extend it for a period of about 8 months. There have been a number of delays to this project. But, I am happy to say that permanent drawings have been submitted to the City. And, we expect the 8 month delay will see this project both permanent and then under construction."

Samson : "Yes, Mr. Mayor, with regard to Information Item (f). I went to Committee that day, and I intervened on this and the reason I intervened is that I want this referred to the Cross-Melville heritage district - and, I believe there's a heritage district in Waterdown, as well - for comment because, the practice of the Cross-Melville Heritage district is to come directly to Council. This would be by-passing that. It'd certainly be something which ." (couldn't make out the Councillors next few words) "So, I wanted them to comment on it. And therefore, not to come back to Committee before November 15 th ."

Mayor DiIanni : "So - "

Samson : "So, I'd like - "

Mayor DiIanni : "Well, it's an Information Item. But, as direction to staff, that we quote that additional step of also seeking some comments from that group. Is that essentially what you're saying?" (hear Councillor Samson say something)

"Councillor Pearson."

Pearson : "Thanks, Mr. Mayor ." (couldn't make out Councillor's next couple of words) "actually put a Motion forward as a member of the Heritage Committee and refer this back. And, I'll be sure to take Councillor Samson's directions to Committee."

Mayor DiIanni : "On the report, then. Councillor Whitehead."

Whitehead : "Moved by myself; Seconded by Councillor Pearson that the 20 th report of the Planning and Economic Development Committee be adopted as amended and the Information Section received."

Mayor DiIanni : "Thank you. All in favour?" (hear councillors say carried) "That's carried."
