COMMENT ON - Item #12

"12. City of Hamilton 2014 Commonwealth Games - Post Bid Report (PED06125)

(City Wide)(Item 8.2)

a) That Report PED06125, "City of Hamilton 2014 Commonwealth Games - Post Bid Report" as submitted by the 2014 Commonwealth Games Bid Committee, be received.

b) That Sport Canada be requested to conduct an independent, formal review of the domestic bid process for the 2014 Commonwealth Games.

c) That the 2014 Commonwealth Games Bid Committee, through Tourism Hamilton, be directed to request a meeting with Ontario Minister of Health Promotion to share learning from both the bid and bid de-brief processes. "

Mayor DiIanni : "Just to - and, I know that there was a full discussion at Committee. But, just to be very clear, that all of the members of the bid team worked extremely hard and represented the City extremely well."

"I read, with some chagrin, some criticism of individuals. And, I think it's just unfortunate and unfair that people who volunteered their time were held up to criticism by some Members of Council."

"So, I just want to make it clear from my perspective, having worked with the Committee, that everybody gave 110%." (hear a glass clink) "Councillor Pearson" (hear Councillor Braden say off microphone 'can I be recorded as opposed' - but not certain which item) "Yes, you can."

MOTION TO ADD ITEM #16 TO REPORT - see Information Section - Item (p)

"Application to Amend an Existing Provisional Certificate of Approval (Waste Transfer/Processing Site) Ministry of Environment Reference #7379-6L8QPW, Waste Services (CA) Inc., Located at 306 Lake Avenue North (Hamilton) (PED06120) (Ward 5)(Item 8.4)
"That the Ministry of Environmental Assessment and Approvals Branch of the Ontario Ministry of Environment be advised that should the Ministry approve the application CA-06-01, Waste Services (CA) Inc., applicant , for an Amendment to an existing Provisional Certificate of Approval for an existing waste transfer/processing site to increase allowable waste storage limits from 100 tonnes to 150 tonnes/ day, within an existing facility at 306 Lake Avenue North, as shown on Appendix "A" to Report PED06120, the City of Hamilton requests the following to be undertaken:
(a) That the proponent obtains the necessary building permit from the City's Building and Licensing Division, which is required for modifications to the existing building.
(b) That the amended Provisional Certificate of Approval require the following:
(i) That doors be installed for the Waste Processing and Transfer Building so that the building can be fully enclosed to contain the waste stored on-site at the end of each operating day, to the satisfaction of the Manager of Solid Waste, Public Works Department.
(ii) That the surface of the driveway area between Lake Avenue North and the existing weigh scale be hard surfaced to reduce the possibility of the tracking of material onto the municipal road, to the satisfaction of the Manager of Traffic Engineering & Operations, Public Works Department.
(iii) That the south side of the existing truck access approach be widened to properly accommodate right turning truck movements into the site, to the satisfaction of the Manager of Traffic Engineering & Operations, Public Works Department.
(iv) That the operator of the facility employ a reputable pest control company to service this site and perform a regular inspection of the premises and regular baiting program, to the satisfaction of the Director, Health Protection Branch, Public Health Services.
(c) That the amended Provisional Certificate of Approval requires that a sufficient bond be provided for financial assurance for the removal of any materials left on the site should operations end.
(d) That the amended Provisional Certificate of Approval include a requirement that a Ministry of Environment staff person be identified to the City as the contact for all issues and complaints regarding the subject property.
(e) That all other conditions and requirements of the Certificate of Approval remain in place.
(f) That a copy of Report PED06120 be forwarded to the Environmental Assessment and Approvals Branch of the Ministry of Environment for their consideration.
(g) That the Environmental Assessment and Approvals Branch of the Ministry of Environment be requested to forward a copy of its final decision respecting the Certificate of Approval to the Clerk, City of Hamilton."

REQUEST TO REFER BACK - Item #7

" 7. Hamilton FireFighters Drum Corps Loan (FCS06034) (City Wide) (Item 8.3)

(a) That the request by the Hamilton FireFighters Drum Corps (HFFCC) to forgive their $202,463 debt to the City of Hamilton be denied;

(b) That staff be directed to work with the HFFDC to develop, within 3 months, an approach to pay back the outstanding debt, and bring a report back to the Committee.

(Councillors Collins and Whitehead indicated that they wished to be recorded as opposed to sub-section (a)). "

MOTION: "That Item 7 of Corporate Administration Committee report 06-006 respecting 'Hamilton FireFighters Drum Corps Loan (FCS06034)' be referred back to staff for a report back to the Committee with possible alternate solutions with respect to the debt of the HFFDC owing to the City."

COMMENT ON - Item #3

" 3. Homemakers and Nurses Services Program Update HCS03012 (e)) (City Wide) (Item 8.1)

(a) That an extension of the transition/termination of the Homemakers and Nurses Services Program beyond the target date of April 1, 2006 be approved, with an increase in budget estimated not to exceed $258,580 for the remainder of 2006 to be allocated from the Provincial Social Services Initiatives Fund.

(b) That Council correspond with the Minister of Health and Long Term Care requesting approval for the transfer of $1.4 million provincial Homemakers and Nurses Services funds to the successful community support agency for the provision of Homemaking Services in Hamilton.

(c) That Council correspond with the Ministry of Health and Long Term Care and the Community Care Access Centre requesting that city clients who are eligible to receive homemaking services under the Community Care Access Centre criteria be transferred immediately.

(d) That staff be directed to report back to Council upon Ministerial approval of the transfer of provincial homemakers' funds to the approved community agency in order to identify the termination date of the City's Homemakers and Nurses Program and the fiscal impact of the new termination date on the City's 2006 budget. "

Jackson : "Mr. Mayor, just briefly, I wanted to both thank and express some concern. But, I want to thank staff: Joe Anne Priel and the Department of Social Services. This is about the Homemakers and Nursing Services program to some of our most vulnerable seniors and disabled who still live in their homes. There's about 664 of them who have been on this homemakers program that the City of Hamilton and the former Region have provided for a good 25 years."

"We're the last municipality doing it. Sometimes even though you may be the last, it's still may demonstrate - as far as I'm concerned - you're a pioneer and you're a model that others should be emulated because you're looking after your most needy of your community."

"But, let me just say that at Committee, yesterday, we discussed putting the $258,000 for the remainder of this year, Mr. Mayor, aside from our Initiatives Fund that would look after these 664 clients - these residents - until the $1.4 million from the Provincial Long-term Care Ministry monies is approved and transferred over to the CCAC - the Community Care Access Centre - of our community that will then have an agency that will be contracted, as well, to look after these clients."

"So, on the one hand, I want to commend staff. This has been an on-going matter - and, commend this Council for the last three years; the previous Council and this one for saying, you know, not getting into a tennis match over 664 of our most needy in our community just because of the dollars. But say, we'll find the dollars somehow until, appropriately, the Provincial Government, in its jurisdiction, provides the appropriate funding and has the appropriate agency looking after this so that the City of Hamilton doesn't have to . " (tape stopped. Sorry)

" . but, at least dialogue and discussions are going on. And, hopefully, by the end of this year, without any pain, discomfort or discontinuation, or disruption of service, the 664 most needy will continue to have home-makering services one way or another. Thanks, Mr. Mayor."

Mayor DiIanni : "We're onto Motions, now.

7.1 Motion by Councillor McHattie respecting establishment of a City of Hamilton Pedestrian Committee (to be distributed)

" Re: Establishment of a City of Hamilton Pedestrian Committee

Whereas, Pedestrians are defined as those individuals moving by foot from place to place or at a walking pace (for example, users of mobility devices, children on tricycles), and

Whereas, young children and seniors are most at risk for pedestrian injuries according to the City of Hamilton's 2000-2002 Traffic report when compared to the age distribution of the City population, and

Whereas, walking is a free and direct means of accessing local goods, services, community amenities and public transit, and

Whereas, walking is a proven method of promoting personal health, well-being, and community safety (e.g. more eyes on the street), and

Whereas, walking is the only mode of travel that is universally affordable and allows children and youth, and people with specific medical conditions to travel independently, and

Whereas, walking promotes environmental sustainability and

Whereas, a pedestrian-friendly environment encourages and facilitates social interaction and local economic vitality;

Therefore, be it resolved:

(a) That a City of Hamilton Pedestrian Committee be established, designed to address the following issues including, but not limited to:

(i) improved pedestrian safety and better pedestrian access;

(ii) pedestrian-oriented input to use of public space;

(iii) provision of comments and recommendations on City policy to City Council and City staff;

(iv) provision of a forum for public consultation on pedestrian health and safety;

(v) promotion of walking; assistance in provision of education materials;

(vi) consideration of a Hamilton Pedestrian Charter.

(b) That the Committee membership be comprised of the following:

(i) Three Members of Council

(ii) 3 citizens appointed by Neighbourhood Associations or Community Councils

(iii) 1 representative from Hamilton Police Services

(iv) 1 representative from the Public Health Department

(v) 1 representative from the Traffic Department

(vi) 1 representative from the Planning and Economic Development Department

(vii) 1 representative from the Seniors' Advisory Committee

(viii) 1 representative from Advisory Committee for Persons with Disabilities

(ix) 1 representative from the Hamilton Cycling Committee

(x) 1 representative from the Hamilton Wentworth District School Board

(xi) 1 representative from the Hamilton Wentworth Catholic District School Board

(xii) 1 representative from "Transportation for Livable Communities", "Green Venture", or other pedestrian advocacy group

(xiii) up to 3 citizens selected at large

(c) That the General Manager of Public Works bring a report to the Public Works, Infrastructure and Environment Committee addressing the following:

(i) inventory of previous and existing activities related to the issue if any

(ii) reporting structure, workplan and timelines

(iii) responsibilities of committee members

(iv) proposed budget allocation requirement and source of funding

(v) staffing requirements

(vi) other necessary resources

Mayor DiIanni : "And, Councillor McHattie, you have a Motion regarding a Pedestrian Committee

McHattie : "Thanks, Mr. Mayor. I do. Moved by myself and Seconded by Councillor Morelli to Establish a City of Hamilton Pedestrian Committee and the Motion is in front of the Councillors."

"Just to highlight the second section there, the intent of the Committee is to [(a)(i)] improve pedestrian safety throughout the City - pedestrian access; to focus on [(ii)] 'pedestrian-oriented input to use of public space;' to [(iii)] provide 'comments and recommendations on City policy' to City staff and Council; [(iv)] provide a 'forum for public consultation on pedestrian health and safety;' [(v)] to promote 'walking; assistance in provision of education materials' on pedestrianism; and [(vi)] to consider 'a Hamilton Pedestrian Charter'."

"And, we've actually listed here, as well, the Membership of the Committee - representation from different staff. And, Mr. Mayor, if I can - working with my Seconder, Councillor Morelli - item [b](v) in that list says: '1 representative from the Traffic Department.' And, in consultation with the Public Works Department, earlier today, they would like that changed, if possible, to '2 representatives from the Public Works Department - 1 from traffic and 1 from Capital Planning'."

"So, that's the Motion before us. And, I just note the last point there, that we've asked Scott Stewart, General Manager of Public Works, to come back to PWIE [Public Works, Infrastructure and Environment] - Public Works Committee - with a sense of how to set the Committee up and some of the details with that."

"And, Mr. Mayor, if I can just speak to it briefly. I'd like to thank Councillor Morelli and the Police Service's Board connection that he provides to supporting the Committee. And indeed, Councillor Morelli indicated a willingness to be on the Committee."

"And, the focus there, of course, is pedestrian safety. And, ensure that safety is - occurs throughout the City. And, Chief Mullan is also very supportive - came forward. We - I had e-mails from the Public Health Department interested in the exercise - the movement part of walking, I guess. And certainly, the Traffic and Public Works folks, Planning - and, we've got folks from the Seniors' Advisory Committee on here; and, the Advisory Committee for Persons with Disabilities; connections to the cycling folks and whatnot, as well. So, I think it's a comprehensive committee to look at pedestrian issues across the City. And, we look forward to putting that together. Thanks."

Mayor DiIanni : "Thank you. Can I ask that you might consider - and, perhaps, it is going to be considered - are the school safety zones, as well? We had a committee last term of Council - because I know you had issues and I think, probably all of you have had issues with that. So, if you could also look at that as you deal with this issue, that would be helpful."

McHattie : "Certainly."

Mayor DiIanni : "Councillor Whitehead

Whitehead : "It's a great initiative, I'm just trying to understand the cost implications and staff time implications on such a committee."

"How often do they meet? How much do they pull from their individual jobs? There's quite a few staff here, I see, from every facet of the community."

"So, is there a costing on this exercise, at all?"

McHattie : "The - if I can just step in there - Item (c) in the report asks the General Manager of Public Works to come back with some of that information: reporting structure; work plan; time lines; proposed budget allocation; staffing requirements and that sort of thing. So, that's what we're going to have to come back with."

"The Committee started off, quite frankly, Mr. Mayor, fairly small. And, a number of staff got in touch with me when they saw the item, to join on with the Committee. But, I think Councillor Whitehead's quite correct. We need to have staff come back with a sense of the costing, the time implications and that sort of thing."

Mayor DiIanni : "Councillor - Whitehead, you were done, right? Councillor Morelli."

Morelli : "Mr. Chairman, if I could just address that issue, I think that, obviously, we want to know what it cost. But, I'm going to tell you that the experience today - certainly around such places as First Place - is probably the classic example of where we've basically carried out this process. It's actually imperative that we set something in place."

"And, I want to salute the good Councillor for doing this. And, obviously, we can ask the cost. But, I can tell you, in terms of the need base - given the fact that we're seeing increased traffic and increased speeds in the street, and, certainly, more of a senior population, I can assure you that in working with the good Councillor as he brings this forward that - certainly, we will look at the cost. But, I can tell you that this has to occur. If anything, it's almost imperative regardless. Thanks."
