Hamilton LACAC (Municipal Heritage Committee)
April 28, 2005

The meeting was called to order at 12 noon.

  • Councilor Pearson was present / Councilor McHattie was absent.
  • there were no declarations of interest.

Presentation:

Provincial Locations Library - Jacqueline McNeilly, Hamilton Film Office

  • in 2004 $10.5 M of direct spending occurred as the result of filming in Hamilton
  • filming locally increases the profile of Hamilton , increases pride in community, and increases awareness of Hamilton 's heritage
  • request the committee's assistance in suggesting more sites to add to the current list of locations in Hamilton that might be of interest to filmmakers

  • approved as printed
  • Councilors McHattie and Pearson were absent as well as were 3 citizen representatives
  • the committee nominated 4 of its members for both the Outstanding Achievement and Volunteer Services AwardS for 2005 from the Ministry of CItizenship and Immigration
  • the committee brainstormed around possible interested parties and alternative uses for the Tivoli Theatre (discussion not recorded)
  • the committee discussed the cottage and cemetery on the property of St. Paul 's Presbyterian Church / the church is designated, these other features are not / there are concerns

Business Arising from the Minutes

1. 309 Main St. E. - Magill House

  • request for designation denied. A letter was sent to the property owner outlining the reasons ( insufficient historical and architectural value / the original owner never lived there / renovations have reduced its architectural heritage value) and thanking him for his interest in the heritage of the property.

2. Red Hill Creek Valley

  • a letter was sent to Chris Murray, Director of the Red Hill Valley Project, to make him aware that the Hamilton LACAC still has a strong interest in the area's historical value, and would like C. Murray to contact them, at the appropriate time, to discuss designation/recognition of some type for the Red Hill Valley.

3. Lister Block, James Street North

  • letter was to be sent to Mayor DiIanni requesting that the Hamilton LACAC be provided a presentation and be involved in the design discussions for the building's new use. In discussion with the Mayor, he indicated that because the property is private and not city-owned, he could not take these recommendations to the owners.

4. St. Mark's Church

  • P. Shaker and D. Dent contacted Councilor Bratina for an update. No response to date.

5. LACAC Visioning Exercise

  • An apology letter was sent to Karen Daniels regarding lack of attendance at the March 10th Visioning Session. The exercise was rescheduled April 13, 2005 .

6. Bill 60; Ontario Heritage Amendment Act

  • the Committee was to prepare a letter to Mayor DiIanni requesting that the Mayor send a letter to the Government House Leader, the Honourable Dwight Duncan and the Premier indicating support for the passage of Bill 60; the Ontario Heritage Amendment Act. However the Act was passed in the interim making the request redundant.

1. 115 St. Clair Avenue - approved

  • located within the St. Clair Heritage District
  • replacement windows and addition

2. 997 Beach Boulevard - approved

  • located within the Hamilton Beach Heritage Conservation District
  • door and window replacement

3. Philip Shaver House, 1034 Garner Road West - approved

  • roof replacement

These will now go to Council for consideration.

Requests for Heritage Designation:

1. 276-278 King Street West , Hamilton - approved

  • this will now go to Council for approval

2. 140 Erie Avenue , Hamilton and 9 Kinnell Street , Hamilton - approved

  • these will now go to Staff for research and recommendations.

LACAC Sub-committee Reports:

1. Joint Plaquing Sub-committee (LACAC and Hamilton Historical Board) Meeting Minutes

  • still no LACAC appointment to the Joint Sub-committee as mandated
  • LACAC formed a Sub-Committee to establish a LACAC list of plaquing priorities

2. Heritage Permit Review Sub-committee

  • see Applications for Heritage Permits above

3. Education Sub-committee

  • no report / Chair absent
  • discussion around LACAC having an information table at the Waterdown Book Fair, November 2005 - approved

4. Inventory and Research Sub-committee

  • no report

5. Policy Sub-committee

  1. Request to facilitate a comprehensive application of the City's heritage program within all City Departments - withdrawn / protocols are in place
  2. Recommendation that Council adopt a core area restoration initiative that would target underused heritage properties in the core for municipal office accommodation needs - approved / Councilor Pearson will raise the issue at the next Planning and Economic Development Committee meeting

  • meeting with architects scheduled early next month

13. Tivoli , 108 James Street North

  • the 180 day hiatus on demolition is up / no building permit application for the site has been submitted to date / until one is and approved by the Building Department, no further demolition can legally occur
  • meanwhile, although Bill 60 has passed the House, it has not yet received Royal Assent / until then a building permit application could be submitted and approved (see above) and demolition could proceed
  • once the Bill receives Royal Assent, the City can stop demolition / the owner can appeal to the OMB

1. Visioning Exercise, April 13, 2005 : LACAC Mission Statement

  • draft mission statements were received and discussed / decisions tabled until the May meeting

2. Built Heritage Emergency Management Protocol Report - approved

  • this 19 page protocol was developed in light of the Tivoli Theatre incident
  • it will now go to Council for consideration

Committee members were encouraged to attend an Inventory & Research Committee meeting to determine their interest - tabled to May.
