Changes to the Agenda :
Addition of two in camera items respecting matters before boards or tribunals;
Addition of a delegation request from Elizabeth Manganelli of Hamilton Health Sciences;
Addition of item 8.3. Clerk reported that councillor Ferguson had asked that 8.3 be added and be the first item on the agenda to allow the proponent to leave the meeting quickly.
8.3 Application for a Further Modification in Zoning for Lands Located at 121 Fiddlers Green Road (Ancaster) (PED05145) (Ward 12) Tabled at previous meeting to allow discussion with the neighbours. Whitehead asks Ferguson to provide an update. Ferguson simply moves acceptance of the staff recommendations. Whitehead then asks Heather Travis, staff planner, "Do you have anything to outline in the proposal?" Travis: "The residents that had concerns, we met with them on site last Wednesday, and we've addressed the concerns that they had by adding some fencing and ensuring that trees would be saved at the site plan stage. And we're ready to put the bylaw forward." Whitehead: "Thank you. I have councillor McHattie." McHattie: "To councillor Ferguson , I wonder if you could just update us on what the issues were and what has been resolved, and what the difference is between now and then? I just can't recall." Ferguson : "As of right, this property owner had permission to build three. The developer let it go with two. Neighbours were concerned about setbacks from the south side. That's been resolved through a fence and through a planning strip, and tree preservation. So it's a good example of cooperation with the proponent and neighbours, along with Heather's skilful stickhandling. There is HSR here." McHattie: "There is HSR. Just in terms of process, just so I understand how these things come forward to us. Is this the kind of thing - is it a last minute thing that we just receive this today, like they agreed yesterday, or is it the kind of thing that we can have on our agenda so I can sort of think about it a bit? Because quite frankly with all the volume of things that we get coming through to us, not only planning but all the other things, I can't quite remember this in detail, so I'm just going with councillor Ferguson's direction on it. Which I'm happy to do, no comments there. But for me to actually sit down and make an informed decision, think about this, decide whether things have been cleared up, the planning issues, etc., I'd have to sit down and read it and think about it. So maybe I can just ask for clarification on process, as to why this sort of thing comes this morning versus being on the agenda?" Whitehead: "We did have this discussion at agenda review, so it did follow due process, there was a discussion at agenda review, and it was put on this agenda. In fact, the only thing that's changed is that we've asked that it be moved up on the agenda so it can be dealt with at the front end." Ferguson says something about a public meeting in Ancaster. McHattie: "Where is it inhe agenda package? I don't see it in my agenda package. [It wasn't in the agenda, or listed, but a copy of the staff report was circulated just before the meeting]." Clerk: "This item was tabled at our meeting of the 18th of October. The only items which were not finalized were as councillor Ferguson has said, have to do with the landscaping strip and the way the driveways were to be configured. The items were discussed, as Heather said, with the neighbours, and once the neighbours had been satisfied, this was to come back to the agenda as soon as possible. .just had a full discussion [ 5:29 ]
