Staff Recommendation:

  1. That Council endorses the outcome of Request for Proposal No. C11-122-04. The Supply of Natural Gas to the City of Hamilton resulting in a roster of three (3) qualified natural gas suppliers, having met the City's minimum requirements as stated in the RFP document:
    1. Sempra Energy Trading
    2. iWPS Energy Services
    3. Superior Energy Management
  2. That Council authorizes staff to negotiate and enter into a master natural gas agreement with the following requirements: (three year term beginning Nov.1/04 etc)

13.1     Private and Confidential re Central Composting Facility (See Item 9.1)

Background: Herhof `s lawyers say the City changed the RFP parameters after the bids were submitted, effectively awarding the contract to Maple Reinders without full requested technical requirements being met. According to Herhof their bid was rejected despite meeting that particular requirement which meant their cost was higher.

Committee went 'In Camera' 11:08-11:50 to discuss this item. CATCH understands, from comments after the meeting, that Staff stand by their decision based on a superior bid overall, and the City will be on firm ground in this regard. Despite reported disagreement amongst Members, once back in Public Session Committee voted to take NO ACTION. This is confirmed in the report to Council (item 5) found at this link:
